Judge: Teen can't wear gun T-shirt to school

We read:
"A federal judge sided with a southcentral Pennsylvania school district in a dispute over whether a high school student should have been barred from wearing a T-shirt with images of guns on it. "Students have no constitutional right to promote violence in our public schools," U.S. District Judge James Knoll Gardner in Allentown wrote in an opinion issued Tuesday.

Donald Miller III, now a 15-year-old sophomore at Penn Manor High School in Millersville, was given detention in December after he defied an assistant principal's order to turn the shirt inside-out. Images of two guns were printed on the shirt, along with phrases including, "United States Terrorist Hunting Permit No Bag Limit."

Miller's parents sued the school district earlier this year, arguing that his freedom of speech was violated. The shirt, a gift from an uncle who is stationed in Iraq, was intended to be a patriotic show of support for the troops, they argued.

Just a picture of a gun "promotes violence"? Very shaky reasoning. Could it just possibly promote self-defense and thus DETER violence? I would have thought that stomping Old Glory was more likely to promote violence. And we all know that THAT is protected speech.

Wanna guess that the judge is just a doctrinaire gun-hater? (Though he probably owns one himself, on past precedents. There's one law for "the little people" and another for the Leftist superior beings).

To say some gun t-shirts are ok and others are not ... that won't fly. But is there really a big difference between guns on a t-shirt and skulls with daggers and drops of blood?

I hope this family has the funds to fight this idiotic and obviously biased decision, or at least seek help that's available from many different groups.

This seems to be another case where the First Amendment is only enforced for those on the Left, something we had better get used to. Or fight.

If the school has a policy that states no gun images are allowed on campus, then as long as enforce it evenly its their right. I think it's stupid to even imply a picture of a gun will incite violence, but highschool kids are minors or are around minors, so rules for free speech are different. If the tee-shirt with the gun should be allowed as free speech, then kids should be allowed to wear even the most vulgar tribute to thier favorite porn star. Any racist statements should be allowed also as long as it doesn't outright call for violence. After all, "free speech" should be protected anywhere all the time, right?

What if the student had said he was merely advocating his 2nd Amendment right?

Nice one Anon 4 - although I'm sure that the judge in question would have no problem deflecting that one.
As for the story - the mere depicition of a gun in connection with a clearly political statement does not amount to promotion of violence in any sane person's book IMHO. (Maybe violence against terrorists???)
However, stomping on any flag neither promotes nor causes violence... the fact that some people may then react with violence is another thing altogether and shows how little the attacker values the very rights the flag stands for...

Where is FIRE (I guess they'll get on to the case now)?
Where is the ACLU (I know they won't)?

Where is that protector of human rights, the Obamessiah? (don't even bother to answer)

I think a 15 years old boy is too young to get involved into weapons culture. To support to his relative a picture like this is unnecesary, words are enough.

Greetings from Spain!!

@twat boy: You should know this since you are from Spain, but ss the Islamic community in the world grows, it is inevitable that hostilities by Muslim extremists toward U.S. citizens on U.S. soil will grow significantly. It is essential that we are prepared to defend ourselves, and we need to teach our young adults the proper and safe handling of guns.

People should not be afraid of guns. People should be afraid of the people carrying those guns.

I would hope that the kid would find a textbook at the school that had one picture of a soldier carrying a gun. Then just walk down the hallway with that book, opened up showing that picture. If the school did something, the kid would need to keep quiet, since the best would be coming up later. Hopefully, the kid would be suspended for this action, at which point the kid could SUE the teacher that gave him the book!!!

Either that or a T-Shirt with a Big Number 2 on it. No names or anything else, but the number 2.

I know that 40 years ago, many people wore things with the number 13 of them. Since the 13th letter of the alphabet is a M and that stood for Marijuana.

Remember that the Pen is Mightier than the sword, since I can carry a pen through a security checkpoint and then stab someone with it. Try that with a sword and you will get stopped at the checkpoint.

...and if the ETA gain political control and become the police???

wouldn't you like to have a gun on your side?

I suspect a big change in attitude toward individuals arming themselves from twat boy if the Muslims AGAIN take control of Spain. The first time, it took nearly 800 years for the indigenous Europeans to rise up and expel their Muslim oppressors from Europe. Spain was the (among the) first one conquered, and the last one liberated. The Muslims have put in motion their bid for conquest #2.

twat boy,

Congratulations on joining the ranks of the millions of sheep who depend on the police to protect them. I guess you're different in that you'll be able to convince an attacker/robber/criminal to stand there until you have called 911, after which he will also wait for the police to arrive. Please share with us how you accomplish this.

You have three choices in life: to be a sheep, a wolf, or a sheepdog.

Reading your coments I can understand the difference beetwen you and me. Here in Spain there is a reject to weapons culture, there is no weapons culture. The less weapons in people hands the less shoots will be. We´re not sheeps, it´s only we don´t like guns. ETA will never win, never. I don´t need guns against bombing cars. And muslims didn´t conquer Spain, they conquered a territory with many small tribes, Spain didn´t exist then. And muslims cities like Toledo and Córdoba were the most important cultural centers at the time. For example, Toledo had the most important language traduction center in the world at the time.
I finish this speaking today, I can understand there are many cultural differences beetwen us in this stuff, only that. Greetings.
