Now we see what moves the notorious 9th Circuit

We read:
"A long-awaited obscenity trial opened in the US overnight amid controversy after revelations that the top federal judge hearing the case posted sexually explicit material on the internet.

Judge Kozinski, 57, was reported to have posted a photograph of nude women on all fours painted to look like cows, while a video on the site showed a semi-naked man cavorting with a sexually aroused farm animal.

He was quoted by the Times as saying he did not believe any of the images on the site qualified as obscene. "Is it prurient? I don't know what to tell you," he said. "I think it's odd and interesting. It's part of life."

Judge Kozinski, who is chief judge of the US 9th Circuit Court of Appeals, is widely viewed as a champion of free speech who once led a successful legal bid to remove filters that blocked access to internet pornography on computers used by 9th Circuit staff.

A judge without the sense to recuse himself in the face of a glaring conflict of interest?

The problem is, judge's use the "reasonable man" test for many of the issues that come before them - obscenity included.

The assumption of that test is that the judge can tell what a "reasonable man" holds as his values.

This judge, who can't tell whether "cavorting with aroused livestock" is obscene, is unable to apply the "reasonable man" test - but he still will.

How typical of the 9th Circus, which BTW, is the most overturned court in the country! Any wonder?

No wonder the Ninth Circus hands down so many rulings that fly in the face of reason - it's led by a pervert who thinks he's a "reasonable person", but wouldn't know reason if it bit him in his most prized intimate place!

Actually it appears the Judge has considered recusing himself but only after the news broke and only after he's already forced a jury to watch hours of the material in question.

If he does recuse himself the jury will be dismissed and a new Judge and jury will have to be found.
