"A retired U.S. Army chaplain is being threatened with legal action for flying the American flag in his front yard, the Daily Mail reports.
Fred Quigley, 77, of Macedonia, Ohio, a minister who served active duty during the Vietnam War, has been told by the homeowners’ association that his flag violates the property rules. The association has offered to fly the flag at the entrance of the building development, but Quigley refused the offer.
“If they can dictate to me that I cannot fly an American flag in America, then, to me, the country is lost,” Mr. Quigley told the paper.
Quigley's lawyer Gerald Patronite said the association has no right to stop his client.
Members of the local American Legion post joined Quigley last week in a flag-raising ceremony in protest at the association's policy.

Although I see nothing wrong with flying a flag, people who move into houses that have an owners' association agree to those rules when they buy the property. Being a valid contract, I don't have much sympathy for those who whine about the rules afterward. Personally, I would never live in such a place.

In fact, most people would be amazed if they knew how much power these so-called homeowners associations actually have. In most places, they are run like mini-Third Reich's, usually by older Jewish people who have moved there from somewhere else, and who now find acting like the Gestapo and telling everyone how they must live is all they have in their lives.
The entire concept of these associations needs a "very close" congressional examination. Also, it should be a federal crime to stop a legal citizen from displaying the nations symbol. The SCOTUS decided that burning our flag is a protected act, but not displaying it. Now you know why "USA" should be replaced by "FUBAR"!
If it was a muslim flag, i am sure that would be approved of.
Does a homeowners' association have the right to impose a rule that would otherwise be contrary to local, state, or federal laws? If so, end of story. If not, then that rule could certainly be contested.
Just get everyone in the neighborhood to fly the flag in defiance. The HOA will have a tough time issuing citations to everyone and the board members will likely be ousted pretty quickly.

If it is a policy ,not a law , rule or bylaw , just convince who ever it is that dictates policy or have a majority of home owners vote to dissolve the HOA .

Really? I have very little experience with Homeowners Associations but how many can be run by older Jewish people (except perhaps in Florida)?
Did the HOA have that rule in place when he bought in or did they add that rule just because of him?
Most HOAs just grab a copy of some existing HOAs rules and adopt them for their own without ever taking the time to examine them critically. Then later on the only people who will take the time to be on a HOA board are those with the desire to see every rule enforced no matter how petty or ridiculous.
Conflicts like this are normal and inevitable.

I live in FloriDUH and have a great deal of experience with these associations, which is the basis for my comment. I use Jewish people because that's what the overwhelming majority are.
sig: No matter what bylaws they make, they can not be contrary to State or Federal law, and in many cases they are. But you should see their faces when you show up with a lawyer and threaten their pocketbooks.
