After 9 Years, HOA Revokes Veteran’s Right to Fly American Flag in Front Yard

Nine years after he was given permission to flag an American flag in his yard, and began doing so, a veteran is now being told he must remove it, he says.

Wayne Marchant, who served four years active duty and four years in the Air Force reserves, says his Home Owners Association (HOA) has suddenly rescinded permission to flag in front of his Franklin, Ohio home.

According to the HOA, flying the American flag a home’s yard “does not comply with the communities standards,” Local station WLWT reports:

"As a veteran, I wouldn't think to erect a flagpole and fly the American flag would be something that I would have to get permission to do," Marchant said.

Marchant moved into Franklin's Renaissance subdivision nine years ago. He said then, the homeowners association gave him verbal permission to install the pole and fly the flag.

Omni Community Association, the HOA, says its board will consider Marchant’s complaint and issue a final decision.

Becuase the sight of old glory offends the snowflake neighbors with their rianbow flags with the chicken footprint peace logo of the 1970's Time to Move out and tell the housing authorities to Go Pound Sand

Which says far more about the degradation of those "communities [sic] standards" than they intended to admit.

The alleged "permission" was verbal. With the changing of the property to new ownership, the new owners and management company can and should only go by what is it the covenants and the written documents.

But this is not what the HOA said.

From the cited article:

Last Friday, he received a letter from his HOA management company, Omni Community Association Managers, LLC, which said, "During a recent inspection, it was observed that a flag pole has been erected in your front lawn which does not comply with the community's standards, which violates the Deed Restrictions and/or Rules, as such, the structure needs to be removed or modified to meet applicable standards; and to ensure compliance."

The issue is not the American flag (which can be flown from a pole attached to the home.) The issue is the FLAG POLE.

This is one of those cases where a blog is making a case to be more than it is.
