Another stupid "anti-discrimination" law coming up?

Anti-discrimnation laws mostly give false hope to the hopeless and make it more troublesome to hire people. If an employer is not allowed to say that blacks, women, cripples and the currently unemployed (for instance) are not wanted, that is not going to alter whom he will hire. It just makes blacks, women, cripples and the unemployed waste their time sending in applications that will simply be trashed
While you hear a lot about the powerlessness of the unemployed, movements like the one Wiedemer has organized against Monster.com are gaining traction. The petition calls on Monster to reject advertisements that prohibit currently unemployed job seekers from applying. New Jersey politicians are not waiting for this type of moral suasion to work and recently outlawed job ads that bar unemployed applicants. Similar bills—which have deep implications for free expression, anti-discrimination law, and freedom of contract—are pending in other states as well as in the U.S. Congress.

It’s hard to feel sympathy for an employer who won’t even take a résumé from an unemployed person. But it’s harder to imagine how inveighing against a job search site will help jobless applicants or hurt those discriminating employers.

The more serious question should be, shouldn't an employer have the right to discriminate when hiring workers?
Don't you have the right to discriminate with people who come into your home? Why should a place of business be any different?

What is the reasoning behind not accepting applications from unemployed applicants? Why are they undesirable?

I only know 2 people that are truly unemployed that could be.. One is 22 years old the other is about 35.. They have both been unemployed for at least a year.. They have also been milking the hell out of their unemployment benefits that entire time and have not at all even bothered to look for a job.. Employers want people who are motivated to work, not people that are fine sitting around for a year doing absolutely nothing but cashing their unemployment checks.. Now Im not saying that every unemployed person is as lazy as the 2 I know but I know they are not the only lazy unemployed people out there..

Until and unless (and I do fear it may be coming) the government imposes strict quota requirements for proportional hiring (i.e., if your work force is "out of balance", you must hire the right ethnic to balance it on the next hire else you cannot hire at all without being in violation of some law and subject to some penalty), there is nothing that they can to to prevent clever interviewers from indentifying some job related deficiency in anyone they don't want to hire. They just impose a record-keeping burden so that you can demonstrate that deficiency in those you didn't hire and the lack of that deficiency in the one you hired. And if you make hiring (and firing) protected people too burdensome, assuredly less of those protected people will be hired. [See ADA - less hiring of disabled since passage.]

In this current economic malaise, employers are now inundated with resumes and applications for positions. They have to have a way to cut down on the time it takes to wade through the paperwork. Many unemployed are unemployed because it is deserved. Rather than wade through the riff raff, employers are coming up with general rules to help them in the selection process. They will miss out on good applicants with this technique; however they are also weeding out an exceptional number of bad eggs in the process. The government making laws banning the practice is creeping fascism. If you at all believe that once the economy picks up (if it ever does) that these laws will disappear, you sir, are a moron. And I have a few bridges to sell you and some land in Florida.

Anon, this practice has been going on for a long time. Right now, the NYC Fire Dept. is in the hands of a very liberal federal judge in NYC who has ordered them to hire more blacks. The complaint from blacks is that they can't pass the same entrance exam as everyone else, which to them means, the test is "racist". Of course, the judge agreed. The result is that the entrance exam will now be altered to make it easier for blacks.

In very, very, liberal NYC, (Manhattan) the people prefer political correctness over true qualifications. Until that is, it's THEIR house that's on fire.
