NC: Judge rules “Choose Life” license plates unconstitutional

"A federal judge ruled on Friday that North Carolina’s anti-abortion 'Choose Life' license plates violated the First Amendment of the United States Constitution.

In his 21-page opinion, U.S. District Court Judge James C. Fox said that the state Legislature’s decision to offer a 'Choose Life' license plate, while refusing to offer a pro-choice alternative 'constitutes viewpoint discrimination in violation of the First Amendment.'

North Carolina began offering the plates in 2011 as one of 79 specialty plates approved by the Republican-controlled legislature and signed by Democratic Gov. Bev Perdue."

    Well, I understand the not offering a pro abortion license plate alternative, but something tells me they wouldn't hold a NAACP plate unconstitutional because there's no plate for a white advocacy group available..

    This one is simple. Either the state allows both viewpoints or neither.

    In this case the the state choose not to allow a "pro choice" plate not once but 6 times.

    The judge rightfully found that the state cannot discriminate on the basis of viewpoint.

    Stan, there's a solution that's even more simple. A state license plate should display the following information ONLY, state, expiration date, tag number. AND NOTHING ELSE!

    We see these problems simply because states are so desperate for revenue. But once it starts, there's no stopping it.

    The problem arose when they decided to make a list of 'acceptable' slogans for licence plates.
    That was always going to be exclusionary and amount to viewpoint discrimination.
    It is a sad state of affairs but nowadays you either allow all views or none.

    I should clarify - when I said 'a sad state of affairs' I meant only that it meant less expression rather than more as many, when faced with the choice of all or none, seem to revert to 'none' rather than 'all'.

    Why does there have to be a pro abortion licence plates? The government is actively promoting it already by subsidizing Murder Inc. otherwise known as Planned Parenthood.
